Neither GreenWeb.org nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

3. Limitation of Liability

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

4. Indemnification

You agree to indemnify GreenWeb.org and, its agents, affiliates, directors, officers, employees and partners against any loss, liability or cost arising out of (i) your violations of any applicable laws, rules or regulations in connection with your use of the service; (ii) any breach of the provisions of this agreement by any third party to whom you provide access to your account; and (iii) any claim against GreenWeb.org made by any such third party in connection with the third party's access to your account or the service.

5. Modifications and Interruption to Service

GreenWeb.org reserves the right to modify or discontinue the service with or without notice to you. You acknowledge and accept that GreenWeb.org does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control. Should GreenWeb.org exercise its right to terminate the service, (a) you will not be entitled to any refunds of any usage fees or any other fees; (b) outstanding balance for any part of the service rendered through the date of termination, and other unpaid payment obligations during the remainder of the term of this agreement will be immediately due and payable in full; (c) all of your historical report data will no longer be available to you unless you and GreenWeb.org enter into a written agreement for the exchange and transfer of such data.

GreenWeb.org may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

7. Proprietary rights

GreenWeb.org shall own all rights, titles and interests, including without limitation all intellectual property rights in the service, (and any derivative works or enhancements thereof) which includes but is not limited to the proprietary GreenWeb.org tracking code, reporting system and website. Without limiting the generality of the foregoing, you agree not to (and to not allow any third party to) use the trade marks, service marks, trade or business names, logos, domain names, other distinctive brand features or any other copyrighted material or other proprietary rights owned by GreenWeb.org and which are associated with the service without the express written consent of GreenWeb.org.

8. Other terms

You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by GreenWeb.org, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a registered user. You agree that by accepting this Terms of Use Agreement, you consent to the use and disclosure of your personally identifiable information and other practices.
